2.3 App Store / Play Store age rating
The Podium application is rated 17+ on the stores due to the nature of sports discussions (occasionally explicit language, lively debates, news content). This rating is indicative and does not affect the minimum contractual age set at 15 years.
3. Description of the Service
3.1 Nature of the Service
Podium is a social network dedicated to sports. The Service allows users in particular to:
- view a personalized sports feed (Forum);
- post content in the form of posts, editorial articles (Takes), short vertical videos (Scenas);
- participate in discussions, polls, and interactive widgets;
- make free predictions on upcoming matches;
- follow sports entities (sports, competitions, clubs, athletes);
- view Entity Pages automatically generated from public sports data.
3.2 Evolution of the Service
The Service evolves continuously. We reserve the right, at any time and without prior notice unless otherwise provided herein:
- to add, modify, or remove features;
- to modify the interface, ergonomics, or design;
- to introduce paid features, subscriptions, or advertising;
- to modify recommendation and moderation algorithms.
Substantial changes are subject to prior information in accordance with Article 18.
3.3 Free Service at launch
As of the effective date of these Terms, the Service is free of charge. No payment is required to create an account or use the features. This is not permanent: Podium reserves the right to introduce paid features (subscription, premium features, advertising-based monetization), subject to Article 18.
3.4 Predictions — important clarification
Predictions offered on Podium are strictly free and involve no monetary stake. No monetary winnings, nor monetary equivalent (gift card, cryptocurrency, etc.), can be obtained as a reward for a prediction. Predictions only give rise to symbolic badges (Insignia) and possible community status progression.
Podium is not a gambling operator and is not subject to regulation by the French National Gaming Authority (ANJ). Should future partnerships with sports betting operators be introduced, they will be governed by separate specific terms.
4. Account creation and management
4.1 Registration
Registration is free. It requires:
- a valid email address or a recognized third-party account (Apple, Google);
- the choice of a unique username;
- acceptance of these Terms and the Privacy Policy.
4.2 Truthfulness of information
You undertake to provide accurate, up-to-date, and complete information, and to keep it so throughout your use of the Service.
4.3 Confidentiality of credentials
You are responsible for keeping your login credentials confidential. Any action performed from your account is deemed to have been carried out by you, unless proven otherwise. In case of unauthorized use, you must inform us without delay at admin@podium.fan.
4.4 Uniqueness
Unless expressly authorized in writing, a User may only hold one personal account. Multiple accounts created to circumvent a moderation measure are prohibited and may lead to suspension.
4.5 Claimed Accounts (clubs, athletes)
Entity Pages relating to clubs and athletes may be subject to a claim request by their legitimate owner. The claim procedure involves:
- a justified request via the dedicated form;
- the provision of supporting documents proving identity and legitimate connection with the entity (ID card, mandate, official document);
- verification by Podium within an indicative period of 30 days.
Podium reserves the right, at its sole discretion and on reasoned grounds, to accept or refuse a claim request, as well as to revoke a claim granted by error. A claim refusal does not entitle the requester to any compensation.
4.6 Verified accounts (badges)
Podium may grant verification badges (verified journalist, verified creator, recognized analyst, etc.). Granting is at Podium's discretion, based on its own criteria, which may evolve. No acquired right results from granting or removing a badge.
5. Legal status of Podium
5.1 Hosting service provider status
For the majority of User Content, Podium acts as a hosting service provider within the meaning of Article 6.I.2 of French Law No. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN) and of Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a single market for digital services (DSA).
As such, Podium:
- does not control User Content a priori;
- has no general obligation to monitor stored content;
- acts promptly to remove or disable access to any manifestly illegal content reported in accordance with Article 8.
5.2 Publisher status for System Content
For System Content (automated publications such as line-ups, match reports, sports agendas), Podium acts as a publisher. This content is generated from public sports data provided by third-party providers. Podium uses reasonable efforts to ensure accuracy but does not guarantee the absence of errors.
5.3 Point of contact
In accordance with Article 11 of the DSA, Podium designates as single point of contact for authorities, users, and trusted flaggers:
- Théophile Roques, at admin@podium.fan
- Accepted languages: French, English
6. License on User Content
6.1 You remain the owner
You retain all intellectual property rights and neighboring rights in the User Content you post. Podium claims no ownership over your Content.
6.2 License granted to Podium
By posting Content on the Service, you grant Podium and its sub-licensees (including its technical service providers) a worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use that Content.
This license covers the following rights, strictly necessary for operating the Service and promoting Podium:
- host, store, copy, cache the Content on the necessary servers;
- reproduce, distribute, communicate to the public the Content via the Service and any future Podium application or interface;
- technically adapt the Content (formats, resolutions, encodings, thumbnails, automatic subtitles);
- automatically translate the Content for foreign users;
- use the Content to promote the Service, in particular on Podium's social media, on store landing pages, in digital marketing communications, and on promotional materials (presentations, demonstrations, press releases).
6.3 Duration
The license is granted for the legal duration of intellectual property rights. However, in case of deletion of your account or your Content:
- Podium will remove said Content from the Service within a reasonable timeframe;
- Podium may retain the Content in anonymized form for statistical purposes and Service improvement;
- promotional uses made before deletion (ongoing campaigns, screenshots already published) may be maintained without obligation of retroactive removal.
6.4 Warranties
You warrant that:
- you hold all rights necessary to publish this Content and grant this license;
- your Content does not infringe any third-party rights (copyright, neighboring rights, image rights, privacy rights, trademark, etc.);
- your Content complies with applicable laws and regulations;
- your Content complies with the Code of Conduct set out in Article 7.
You shall indemnify Podium against any third-party claim, action, or recourse based on a breach of these warranties, and undertake to compensate any resulting damage, including reasonable defense costs.
6.5 Shared content
When you reshare, cite, or comment on another User's Content, you must respect the author's moral rights and not distort their message. Mass and automated resharing is prohibited.
7. Code of Conduct — Prohibited content and behaviors
7.1 General principle
Podium is a space for sports discussion. The liveliness of debates is part of the experience. But certain behaviors and content are strictly prohibited.
7.2 Prohibited content
It is forbidden to post or disseminate:
A. Illegal content
- child sexual abuse material, content depicting or exploiting minors;
- terrorist content, apology of terrorist acts or crimes against humanity;
- content inciting racial, ethnic, religious hatred, discrimination based on sex, sexual orientation, gender, disability, or any other criterion protected by law;
- Holocaust-denial content;
- defamatory or insulting content, or content infringing privacy;
- content infringing image rights of others;
- content infringing third-party intellectual property rights;
- pornographic or sexually explicit content;
- violent, gory, or shocking content with no informational value.
B. Sports-specific content
- distribution, sharing, or promotion of pirated streams of matches (illegal streams, unauthorized IPTV links);
- sharing of odds, registration links, or promotional content from sports betting operators not licensed by the ANJ or not holding a license in the user's country;
- incitement of minors to bet;
- targeted harassment of players, coaches, referees, officials, journalists, or their relatives;
- identity impersonation of players, clubs, journalists, or officials;
- dissemination of false sports information for manipulation purposes (orchestrated fake transfers, coordinated malicious rumors).
C. Prohibited behaviors
- harassment of other Users (repeated insults, threats, intimidation, unsolicited contact);
- creation of multiple accounts to circumvent a suspension;
- use of bots, scripts, or unauthorized automation to generate content, votes, followers, or interactions;
- massive data collection or extraction from the Service (scraping) without authorization;
- attempts to access Podium's systems without authorization;
- reverse engineering, decompilation, or circumvention of security measures;
- spam, unsolicited advertising, organized religious or political proselytism;
- any activity illegal under applicable law.
7.3 Specific obligations of Claimed Accounts
Holders of Claimed Accounts (clubs, athletes, verified journalists) undertake to:
- publish only content related to their sports or editorial activity;
- maintain a measured tone given their visibility;
- not incite their community to harass other Users or third parties;
- comply with any applicable sectoral regulation (journalistic ethics, federation rules, etc.).
Repeated breaches of these obligations may result in withdrawal of claimed status.
8. Moderation and reporting
8.1 Automated moderation
Podium implements automated moderation tools (text and image analysis by artificial intelligence) to detect content that may infringe the Code of Conduct. These tools may lead to:
- placement of content in a queue before publication;
- automatic hiding or removal of manifestly illegal content;
- application of a visible warning on certain sensitive content.
Automated tools may produce false positives. Any automated removal is subject to appeal in accordance with Article 8.4.
8.2 Human moderation
Reports and certain automated decisions are reviewed by Podium's moderation teams.
8.3 Reporting mechanism (Article 16 DSA)
Any User or third party may report content they consider illegal or contrary to the Terms, via:
- the "Report" function present on each piece of content in the application;
- the email address admin@podium.fan.
The report must include:
- precise identification of the content (URL or screenshot);
- precise grounds for the report;
- contact details of the reporter (except anonymous reports accepted for certain serious content);
- a statement of good faith.
Podium acknowledges receipt of the report, examines it within a reasonable timeframe, and informs the reporter of the decision taken. Abusive or manifestly unfounded repeated reports may result in restriction of the right to report.
8.4 Internal appeal (Article 20 DSA)
Any User whose Content has been removed, whose visibility has been restricted, whose account has been suspended or terminated, may lodge a free internal appeal within 6 months of the decision, by email to admin@podium.fan.
The appeal is reviewed by a person distinct from the one who took the initial decision, within a reasonable timeframe. Podium notifies its reasoned decision. If the initial decision is maintained, the User may refer the matter to a certified out-of-court dispute resolution body in accordance with Article 21 of the DSA, without prejudice to their right to bring the matter before the courts.
8.5 Measures available to Podium
In case of breach of these Terms, Podium may, depending on severity and recurrence:
- send a warning;
- remove or hide Content;
- limit the visibility of Content (de-listing from the Forum, from recommendations);
- temporarily suspend an account;
- permanently terminate an account;
- block access to the Service from certain devices or IP addresses.
The choice of measure is subject to proportionate assessment by Podium. Serious breaches (most serious illegal content, harm to minors) may justify immediate termination without prior warning.
8.6 Cooperation with authorities
Podium cooperates with judicial and administrative authorities. Upon duly reasoned request, Podium communicates data legally required and executes removal, blocking, or disclosure injunctions.
9. Podium's intellectual property
9.1 Podium's rights
The Service, its code, design, interfaces, databases, the trademark "PODIUM FAN" (and the word mark "Podium" in its sports-specific use), its visual identity (logos, color palette, properly licensed typefaces), its Latin-inspired feature names (Forum, Scena, Take, Insignia, Laurea, Gradus, Plebs, @AUGUR, etc.) are protected by intellectual property law and belong to the Publisher or its licensed partners.
9.2 License granted to the User
The Publisher grants the User a personal, non-exclusive, non-transferable, and revocable license to use the Service for personal purposes and in accordance with these Terms, for the duration of their registration.
